From what you've posted here and other threads, you posted the photo of him with the bottle and said 'he's been drinking, lay off of him' and telling us to see how we act after we've had that much. That's where we think you state that drinking should excuse him.
Since you bring up actus reus and mens rea, intoxication is not a defense. The state of intoxication can be used to support another defense and as part of the evidence whereby the accused was so drunk it rebuts the mens rea. Even then, only proof that intoxication happened involuntary (i.e. unexpected side effect of prescription drugs, where the accused was unknowingly or forcibly led to intoxication) can be used as liable defense. Where the intoxication was automatic (voluntary), intoxication is not a liable defense which is the case here. Like I said, it was his choice to keep drinking till it got this far, so I cannot just lay off of him and say 'Oh well he's had something to drink'. He should've kept his drunk ass down and minded his own business especially given that he had no business in the situation.
