Car Accident Help Help~

Hi! Guys, sorry to bother u guys again...

Anyway, my friend got into a minor accident. Basically she rear ended someone, the other party's car only have little scratches on the rear bumper. But the major problem is. When the accident happened, the person said she feel headache and stuff... But after the accident she didn't call my friend at all, until today(almost 2 weeks), my friend got a call from the other persons attorney, because that lady sued her...

Anyway, what should my friend do? She has no clue what to do now...

Yea she have auto insurance....she just told me, it's her insurance company called her, and told her that the other parties attorney filed a lawsuit

Just for curious sake, what insurance policy does your friend have? Specifically the bodily injury damage to others...

Secondly is the insurance purchased by her or by her parents etc? That plays a major role in the next steps... such as hiring a lawyer to defend and so on.

For example if she is a teenager who bought her own insurance, she probably doesn't have much net worth, and sueing would be useless because she has nothing to it with etc. If it were the parents insurance policy then some serious problems can arise, such as the parents being sued, which can be quite costly and damaging, because they generally have more net worth and assets (like a house, car, savings, etc).

I wonder what type of injuries the other party sustained, because back and or neck injuries are kind of hard get in a slow accident, which is indicated by the lack of major damage to her car. Secondly they don't usually cost too much in the hospital for this type of injury, usually no more than lets say $20,000ish, which is usually like the minimum bodily injury insurance required anyways (for California).

If you're friend is being sued, odds are the insurance company is not paying up for some reason, such as they suspect that injury is fake and the other party is trying to commit fraud. If the insurance company refuses to pay, the next step is for the other party to sue your friend to get the money, which is currently happening.

thank you guys for the help...

My friend is 21, buying for her own insurance.. with liability coverage, that covers body injury up to $35,000. I think the reason the other party sued her. because like kelvin6 said.. the insurance company did not want to cover it.. because my friend did not report it... and that's because when the accident happen, that lady told her that she will give her a call later, but she never did... so my friend was thinking maybe she just forget about it, because it was really minor....but she never knew it turn out like this....omg...people are so evil thesedays...

i call bs on the other party, if what you said what happened is true. some low income pos trying to cash out. anyways, hire a lawyer, an investirgator or whatever. if the party is faking it and they find out, they will have to pay for all the court fees and legal crap such as fraud and blah blah blah
