i decided to keep it but the owner isn't canceling the phone service
it doesnt have any sim card.
and if he does cancle it,
can i use the phone?
i saw in the internet that if it is recorded as lost or stolen,
you can go to jail for it. (which is pretty weird)
and i also heard that they can track you down. (for just an i phone?)
And the owner only called twice, i think. and that's it.
Weirdddd....
what should i do?

If the owner has tried contacting you TWICE, I would personally return it.
But then, it's your decision. =/

Also, if the owner reports it stolen, then the carrier can track it down by IMEI number. Meaning, they could put down or blacklist the IMEI number and if they find out someone is using it, basically you calling in to activate it, then they can find out who you are if you already gave them your personal information. The carriers know which phone you're using by looking at the IMEI numbers. Even T-mobile can tell which of their customers are using the iPhone, but they aren't going to do anything because they aren't loosing money.
Just return the phone back to the owner. Don't tell me that the iPhone is a MUST HAVE device and your a Apple brainwashed zombie, and willing to keep the phone.

Btw, I agree with everyone. Your story makes no sense. There's no SIM card in the phone yet the owner can call you?

You should answer it, and let them know you have it and would like to return. They'll probably give you a "reward" for being so honest.
My phone got stolen at work. I called it many times (more than 50) and my coworker answered it and denied that she has my phone (how dumb because it's my phone number -__-). I report it at work. Eventually, Lost Prevention unit tracked the coworker and she got fired. However i didn't get my phone back because my company couldn't find her at her home.
I think you should return it. Morally, it's wrong to keep it.
