Who's Fault Is It? car accident

my mom was pulling out of the driveway and she looked to the left no cars (however there was a couple of vans parked on the side of the road). also the intersection lights were also red so that reaffirm that no cars could've came. so she went out further and suddenly out of nowhere a there was a car that hit her in the front left. i mean she did pull out a little so would the other party see that if they were paying attention? anyway, any insurance specialists here? who's at fault?

Your mom's fault. The other car had the right of way. I can't think of a reason why your mom would have the right of way if she's pulling out of a driveway.

Same thing happened to me, and it my fault. The other driver probably saw your mom but assumed she would stop, sucks : /.

your mom has to yield to both directions before pulling out. why would you even question whos fault it is?

Well, it might not 100% percent your mom's fault, although I must say that it will be a majority your mom's fault...

Did she back out the car from the driveway or was she driving forward out?

Now assuming that she was in reverse to get the car out of the driveway... depending on where the damage occured, and if it is the front and not the middle or the back of the car, it means that the person wasn't paying attention and hit the car, when the car is ALREADY OUT of the drive way (because how else can you hit the front).

she was driving forward out.

yeah, just wondering the factors they use to figure out who's wrong and if both parties could be partial at fault. drivers are suppose to be vigilant and it doesn't mean once you're on the road you can hit anything out there and still be right. there's always what if this what if that. anyway, expect the worse i guess.

Actually fault can be determined by the type and level of damage to each car. Although it would be best to take pictures of the both cars at the accident scene, this ensures that the insurance companies know what the damage really was and to protect you in case the other party wants to sue (more than what your insurance covers) and exaggerates the claim.

I always keep a point and shoot film camera (and fully loaded) in my glove box or within accessble reach from the driver seat, in case of a accident or a hit and run against me. Has come in handy for one big accident that occurred to protect myself from the other person exaggerating the claim.

and jsut fyi just cuz the light is red doesn't mean someone cant be making a left of right turn going the other way wink.gif

similar situation happened to me. it is almost always the car (that's getting out of the driveway) that gets the blame.

so i'm sorry to say, most likely, it will be your mom's fault.

most likely they would say majority of the fault is your moms.

the car on the street going already has the right of way when pulling out or making turns.
