Did she back out the car from the driveway or was she driving forward out?
Now assuming that she was in reverse to get the car out of the driveway... depending on where the damage occured, and if it is the front and not the middle or the back of the car, it means that the person wasn't paying attention and hit the car, when the car is ALREADY OUT of the drive way (because how else can you hit the front).

yeah, just wondering the factors they use to figure out who's wrong and if both parties could be partial at fault. drivers are suppose to be vigilant and it doesn't mean once you're on the road you can hit anything out there and still be right. there's always what if this what if that. anyway, expect the worse i guess.

I always keep a point and shoot film camera (and fully loaded) in my glove box or within accessble reach from the driver seat, in case of a accident or a hit and run against me. Has come in handy for one big accident that occurred to protect myself from the other person exaggerating the claim.

and jsut fyi just cuz the light is red doesn't mean someone cant be making a left of right turn going the other way

the car on the street going already has the right of way when pulling out or making turns.
