서울중앙지법 민사합의25부(부장판사 조원철)는 케빈이 "전 소속사와의 계약이 불공정하다"며 씽엔터테인먼트를 상대로 낸 전속계약효력부존재확인 소송에서 원고 승소 판결을 내렸다고 12일 밝혔다.

재판부는 "계약기간이 첫번째 음반 출반일로부터 10년으로, 가수로서 활동기간 전부에 해당한다"며 "이 기간은 연예산업의 위험성 등을 감안하면 합리적인 정도를 초과, 공정을 잃은 것"이라고 판시했다.

재판부는 "우군의 계약 중 이익분배나 계약 위반시의 손해배상예정액 및 위약벌에 관한 조항은 우군의 인격적 주체성을 심각할 정도로 훼손해 사회질서에 반하는 계약조항"이라고 설명했다.

재판부는 "앨범 발매한 때부터 5년이 경과한 후에는 배분액의 100% 범위 내에 합의 조정할 수 있지만 실제로 음반의 경우 5년이 경과하기 전에 대부분의 인세 수입이 발생한다"며 "이 조항은 의미가 없다"고 밝혔다.
