Scenario:
I was merrily heading home. I was coming from lunch with my ex-boss from my previous company.
I was heading North on Rt. 130, where it merges with Rt. 1 N. [North Brunswick, NJ]
After the merge, there is a straight about 1/2 a mile. The merge is always insane because lots of 18 wheelers come off of 130 to get onto Rt. 1. Trucks are usually driving slower, which causes most cars to speed up/change lanes in this area.
Little did I know, that little strip for the merge.... its a 50 MPH SAFE CORRIDOR.
The road is big enough to be an interstate-highway - it tricks the mind.
I was all the way in the left lane, a 18 wheeler in the middle, it's a 3 lane highway. I was not passing, the truck was actually pulling on me. There was maybe 100~150 feet gap between the back of the truck and me. As the truck starts to pull ahead and widen the gap, in the corner of my eye I see a blacked out Dodge Charger sitting at on on ramp alllll the way to the right. As I pass him, I see him quickly put his radar/laser back in his car and the lights and sirens went off, I got pwned.
My argument in court will be:
"The officer must have got the speed reading of the truck. I have stated to the officer when he replied "Do you know how fast you were going?" I had told him "60-65?".
I plead guilty for speeding, but I am 100% positive that I was not doing 70 mph. The officer might have mistaken me for doing 70 mph from scanning the truck, the truck was pulling on me, widening the gap.
Also, I believe the officer mistakenly pulled me over because I do have a bright red car and my bright yellow shirt was more noticeable to him. This is my first speeding offense and I am deeply sorry. I did not know it was a safe corridor, I will obey the traffic laws in the future."
Basically I want to get the speed down 1 more bracket. This will save me almost double the $ amount in fines because of the x2 safe corridor rule. Worst case scenario - I don't get the speed down one bracket - est $600 fine. 2nd worst case scenario - they bump me down into the bracket below and pay est $300.
Do you guys think this will fly? I mean if the cop says "there was no truck, I caught him square dead on" and the prosecutor believes him... I would say "how could the officer have seen me? I didn't see him... the truck was blocking my vision of the two right lanes in front of me. I only saw u after I passed him, which THEN he hit the siren," Isn't this one of Murphy's Laws of Combat? - If you can see the enemy, he can see you.
Also... is it true if you are from PA or NY and you get a ticket in NJ, points do not transfer over?
Is there anything else you guys would do or say in my situation? $600 isn't small beans!!! I read on some site, that this is a huge trap speed zone and it already had like 12 people reply saying watch out for it. I used to travel this road everyday for almost a year and I JUST found out today, sucksssssssssssssss.

My opinion, No i don't think that would work.
I did have a similar case like yours. maybe worse.. but same arguments.
it's almost like the cop rounded up the speed i was doing so he can get me for speeding + reckless driving.
luckily i didn't get any points with help of a lawyer and PJC. but did cost....
and that was the last ticket i got.
no idea about points being transfered. some say they do and some say they don't......

i hate driving on rt. 1.. there's always construction going on and a lot of drivers drive crazy there..

That is 100% true.
I can't say your argument is good because I've never been in the same situation before, so I don't have a reference point.
Let's hope the cop doesn't show up to court.

The ticket says I am summoned. I am SURE this cop will be there. My friends tell me cops have 2 days out of the month that they have to go to court for all the tickets they wrote, to contest if they must. Also... if he wins, im looking at about a $700-800 ticket. He wouldn't miss this for his life.
I WILL FIGHT the fact that I was NOT doing 70. That mofo prolly rounded the number up, ontop of having scanned the trucks speed.

For me, whenever I get a ticket I take it to one of those Traffic Lawyers.
I've gotten several tickets over the years,
the lawyer charges $50 per ticket to go to court instead for me.
I was able to get $500 down to $300 and didn't have to pay for almost a year,
and knocked off 2 tickets completely.
Might be a good option to try.
