I Hit Someone's Car While I Was Backing Out My Car Spot what should I do?

Hey everyone,

So this morning after I warmed up my car, I looked both sides and rearview, I saw nothing so I slowly backed out (less then 5 mph while I'm on brakes) I hit the right side of a white civic sedan. As I was moving foward a bit just to make sure she stays, she moved her car forward. Then we both got out to make sure everything is okay, she was really upset that I "bumped her car really hard". Apparently she stopped because someone was crossing but she was so close to me with the glare on my back window, I couldn't see her. I made sure I checked side mirrors and I couldn't see her tires or anything. I apologized immediately that I hit her but I couldn't see because of the sun. She has a scratch on her right door and she said I did it. I told her it's not possible because I have a high rise. There are no visible dents and scratches. She asked what apartment I live in and I told her, as I went to my car and get insurance information, she booked it. So I couldn't take pictures or even exchange information. Now I took some pictures of my back bumper and there are few scratches... but my friend loved tapped me before so I'm not sure which one but there is one that's across the bumper so I'm assuming is that. I've talked to 2 of my friends to see if I should call insurance, my guy friend wants me to get a really good story so if insurance gets involved, I can boost my chance of getting the case thrown out. My girl friend told me to take pictures of my car incase the lady tries to jip me for money. I rubbed on the side to see if the scratch is dirt/dust cuz my car is reallly dirty right now, and it seems I can buff it off with wax so my guy friend is washing my car this afternoon and wax it good. But now... what if I left paint on her car? what if her car has scratches and apparently I dont have any? Since she just booked it, will it lower my chance of winning the case? Anything I should do and should not do?

well.. you said sorry... WHY? thats gonna make it sound like its your fault for the dent on her car.. you shoulda get out and exchange info. thats what i would do. i hit some lady's bumper cuz she couldnt drive for sh!t!

u need to get her info as well just in case something random happen..

speaking of which.. i need to buy a camera and leave it in my car when something like this happen to me. haha.

she does not have visible dents on her car... if so I only scratched it. I cannot say it's not my fault and not apologize, in the position I was in, whether she stopped her car before or after I put reverse, I should've stopped backing out. Did you even read what I wrote? I said I went back to my car to get insurance info after I apologized she left.

even if it was my fault, i aint gonna say shiet.. we both know its my fault so why should i apologize. i'll ask how the other person is doing, but thats it. i aint saying sorry.

I know I couldn't get her info or take pics... so it looks like it's my loss, her gain. I'm having my friend wash and wax it good in 2 hours, so hopefully I can get everything off and I hope we will not involve insurance. THERE WAS NO VISIBLE DAMAGE. I dont even know if I should call insurance... she is totally fine. she works at toys r us (she was wearing the uniform) but I dont know which one, I would go take pics of her car but I'm at work so... LETS HOPE NOTHING HAPPENS.... I will post again when there's an update (hopefully she just drops it)

shes in her 20's right.. then thats not good. from what you said, im sure her car is fine but i got a feeling shes gonna try and get some $ out of you.

Did you at least get her license info? If you did, it's imperative that you call the insurance company and police department. The party involved can not leave the scene without exchanging information and a police officer at the scene. With her leaving the scene, she is breaking the law.

She didn't break the law because the police wasn't there and the only thing the officer will say is you didn't get the info or call the cops, since she got your info its her word against yours when you have nothing to back it up.

1. should of gotten her info

2. should of called the cops for the hell of it

3. call your insurance company and tell them immediately what happened, and tell them to expect a call, and explain your side of the story first and warn them in case she wants to jib you (which I would definitely do if someone hits me and didnt take my info lol)

4. next time be ultra careful, and dont leave crazy scratches on your car. I keep my car 99% immaculate, and last time some lady backed into me she lost big time to the cop and the insurance despite no eye witness (cept me and her) due to the fact that my car was in perfect condition and her bumper has been hit so many times it was losing paint.

This is one of the reasons why I keep a camera loaded at all times in my glovebox. I learned this from my uncle and I remember one time, some guy rear ended (the both of us in my uncle's car) and tried to drive away. I opened the glove box and pulled out his camera and we snapped away at the guy and the license plate (also to make sure you get the face of the driver), and busted him for hit and run.

^^^ Specifically, don't admit fault in any way shape or form.

If you do (esp if it gets documented on the police report or insurance company, you basically said you were at fault and take full responsibility).

Playing dumb might actually work. If you do piss off the other person by playing dumb and they attack you, you can tell the police when the come to do the report that they assaulted and battered you... lol. Actually that did happen to me once, where the other guy grabbed me and pinned me to my car and I reported it to the police officer when he came out to the scene. Busted.

thanks for the response everyone. the only info she got was what apartment i live in (we live in the same complex) so if i want to get anything, i can simply ask the manager. i dont think i can call the cops because it's "private property" right? it happened inside the gated parking lot where tenants park, not the guest area.

UPDATE: so i had my guy friend wash and wax my car yesterday, got most of those random scratches off. but the streak is still there (barely visible). and i did call the insurance, of course i did not tell them i apologized, i followed what my guy friend told me to say cuz he had a hit and run and he's the who hit and ran -___-;; i told insurance that i hit the lady, we agreed to exchange info, but as i was going to my car to get insurance information and my camera, she took off cuz she said she was gettin late for work. so i did not have the chance to get any information, insect and take pictures of her car. and of course no damages to my car.

You shouldn't have called insurance then! There was no way the lady could have filed a report because there was no witnesses nor were there any police report.

Nope, police dont file report on private property even if you called them.

However its good he did called the insurance, because if it was me I would of filed a hit and run on the OP and gotten away with a really fat check... even though he didnt run, but he doesn't have my info and I could of really took advantage of it.

I've had friends who got hit, and then the person who hit them reported their car was in a hit and run (and since my friend was shocked and didnt realize it to report it or take their plate down), they got owned.

^ yeah... my friend hit someone and he's the one who ran after they decided to pull off the road, but he called insurance and said that lady ran so he got away with it.. and that's what he told me to do.

UPDATE #2: insurance agent from my area called and he said he's not gonna inspect my car bcuz there's no damage. but he recorded our conversation regards of the accident, so i again told the guy we agreed to exchange information but the lady said something and she took off so i never got the chance to inspect any damage or get any information. last night i saw 2 white civic sedans and i think i looked at the wrong one cuz there were some pretty heavy scratches and it looks like somewhere my car can hit, but i dont have a single chip of paint on my car so... eh. i think i will take a look at the other one tonight...

Better than trying to memorize a license plate LOL, gonna keep a camera around now
