Its hard to say from the picture above if there is any other damage, but it appears that your car escaped serious damage to the frame which is good (the car is repairable).

The damage is in the $1000-1500 range, because you will need a new bumper cover as well as the support beam the fell off and of course the headlight assembly.

Well to determine fault, did you call the police and get a police report filed? Did you notify the insurance company (now if this is one way coverage on the car, you may have to notify the other person's insurance company instead), did you get the other person's info?

I can't determine fault unless you provide us some more info like the description of the intersection and what kind of signal lights are there (and if it was green when you started to make the turn).

I notified the insurance. He came and checked it out himself.

There wasnt a signal.

prolly 2 stop street?

There was a school zone too.

My car was street parked "parallel"

I checked my mirror, didnt see anything.

tried to get out of the street parking and get on lane.

car came out of nowhere den BOOM.

Hmm if thats the case, you probably are at fault in this accident. Judging by the situation:

1.) You were trying to leave a parking spot, which you must yield to other cars on the road.

2.) The damage to your car and the other person's car indicate that the other person couldn't have prevented the accident. The damage shows because the damage of the other person's car is at their fender, which typically means you plowed into the other person. If the damage to your car was your fender (where your tires are) then the other person plowed into you.

3.) The reason for fault in a police/insurance report could be because you failed to check your blind spots and the rear view mirror as you were pulling out (failure to yield to the other vehicle).

You may be able to argue or dispute the percentage of fault, but you won't be seeing a 50% at fault, it will probaby be like 75% fault or more...

Lastly and most importantly, because this was a accident, you need to file a DMV SR-1 report to the California DMV that accident had occured. If your own insurance company didn't file one (because you didn't report it to them, but to the other party), you have to file it yourself. This is for the DMV's records and you have to file regardless of fault, otherwise if you don't and the other person did (if their insurance company did it for them) then you can risk getting your license suspended. If you haven't done it, do it.
