Car Accident

on jan. 12, 2009, i was in a car accident. this is what happen. a police came by with the siren on and i was stopping at the side to wait for the police to go by before going. (the law is that when the police siren is on, all drivers must pull to the side and stop.) then, the person behind me hit me. my head rock back and forth. i came out of the car and the guy starts yelling at me. here goes the conversion:
guy: the cop was in the middle and you could still go.
me: oh, really? in the driver's handbook, it clearly states that when the police or fire amblance siren is on, all drivers must pull to the side and stop.
guy: look you didn't even pull all the way to the side.
me: (thinking) oh, shut the hell up. you know you are wrong and you even know it.
i got the guy's information and he got mine.
some young guy stop and ask if everyone was ok. i say yeah. the young guy even talk to the guy who hit me. after the guy who hit me left, the young guy told me that he has a bad personality. i agree with him.
there are damage to both cars, my car the back bumper is damage (mostly on the left side) and looks like it is hanging for dear life. he car the front bumper was damage, too.

i was scare and crying in public (yes, people say me crying and i don't care.) and in front of my parents. this is my first car accident. i wanted to keep this year free of accidents and stuff.

it has already being report to the insurance company.
around midnight i began to have neck problems. it comes and goes away.

at this point i don't know what to do. *sob* tears.gif

*scare and confuse*


I KNOW I SHOULD HAVE CALL THE COPS. I DON'T WANT TO HEAR ANOTHER WORD ABOUT COPS AGAIN.

Did you at all call the cops? Where are you located? Since traffic laws differ by states and I would have called the cops to the sitaution.

i live in california. no one call the cops. the guy who hit me seem very rude and not want to give up his address and phone number.

this is one you want to call the cops on... and he might be in MAJOR trouble if you have physical issues, because he is at fault, and will have to pay for all your medical bills and repairing the car. you did the right thing, try not to feel so bad; pulling over to the shoulder is what you're supposed to do, that guy broke the rules.

I believe in california that you must file a police report for this type of accident.

Anything that results in a injury of anytype (no matter how slight) warrants a police report to be filed. Without one, trying to sue or even make a claim with the insurance company is difficult.

Doesn't matter what this guy says, if he rear-ended you its 99.9% his fault...

If its not too late, file the police report, give them the information that you have on the other guy and take pics of the damage on ur car and print it (for documentation purposes). Don't heistate, DO IT NOW!

In Arizona if a person hits you in the back or behind the front seats its the persons fault since they were following at an unsafe distance or a distance that didnt allow them to stop in time. Just call the police and tell them what happened and give them the info and they can look into it. Its better to have a police report when they file the insurance claim. Here in AZ it is stated to pull over and let the cop pass so you were right.

i currently hire a lawyer to help me out. i will be going to neck thraphy later today. yesturday, my neck pain has spread a little down to my spine. >__> it hurts. i hope that i don't need surgery. i didn't file a police report yet but i may have to do it soon. it's the second day and i am carefully driving very slow since i have no choice by to drive myself. my car is under repair and driving a rental car now.

since i am planning to sue him, i am worry that he might say this, "the cop was far away and it wasn't necessay to stop." among other stuff i can't remember but was written down.

he won't win it. guarantee you he won't... if he was following too close, he hit you, he didn't have time to stop. And that's your discretion, you had to make sure there was ample room for the police officer, so you should be just fine... I really hope everything goes well for you!

a friend told me that he was trying to blame me for what happen because i was a girl.

anyways, an amblance was came by and ask if anyone was hurt. i say no because at the time because i didn't feel any pain until later that night. will it hurt my case? since my sibling was in the car with me, i think the guy will deny it and say that the cop was far away and there was no reason to stop.

since that i am going to see the doctor today (appointment made by my lawyer), is it too late? will it hurt my case? i think the other lawyer (assuming that i made go to court) may say that the pain came from something else and not the accident. i never had any major problems. this was my first accident. the only thing i go to the doctor for was the flu and cold.

i got in an accident right before xmas. it was green and i'm going straight, as i hit the intersection a lady tried to make a left so i hit her. i clearly told her not to move and she moved so i was like mad.gif then i took some pics and cops came but didn't exactly file a police report because no one was injured, although her vehicle was not driveable tongue2.gif i was okay at the moment but when i woke up next morning my neck was very very sore. i went to see family doctor for referral (but i was told i should be going straight to chiropactor) then i got a lawyer and he got upset that i didn't get treatment for 3 weeks so i immediately started therapy and insurance has filed it's not my fault. so my lawyer's taking care of everything, and during those 3 weeks.. pain spread. first it was my neck, then it went away but my shoulder blades hurt, then spread to lower back/spine when i lay down on my bed im very sore. so it's okay if there's pain AFTER the accident as long as you had no accident or injuries before to let the opposite side take advantage of that. it is his fault and we're in cali, we're suppose to stop. just trust your lawyer and let him to whatever he can, everyone would like to have 1/3 of that fat check. but remember... your lawyer has to be aggressive otherwise you're not gonna get much lol.

No, it will not hurt your case. Everyone who gets into a car accident won't feel any sort of muscle pain until a night or day after the accident.

Even though the other lawyer may say that, the judge should be sensible enough to know that you're having problems after the accident. And it really doesn't matter if you have pain or not, at least to affect whose at fault. If it's declared that the other person is at fault, they can't contest that the pain you are in is not from the accident. Because now they're liable for everything.

I concur. It's fairly common knowledge most people won't feel any pain immediately after an accident. It's due to shock.

I wouldn't worry since u did the smart thing and got a lawyer to take care of everything for you. In California, it's pretty straightforward... the driver that rear-ends another car is automatically at fault. There's simply no question about that. It's all a matter of how much money you're gonna end up getting for your pain and suffering. That will depend on how good your lawyer is.

In regards to the ambulance that stopped by to see if you were ok... did hey actrually make patient contact with you, as in got out of their ambulance and took your blood pressure, did a physical exam, etc.? Or did you sign any papers from them? But yeah, you shouldnt be worried about not being in pain when the accident first occured. Im sure you know that when your body is involved in an injury your body relases a lot of different hormones and chemicals which can hide the pain you had. Also sometimes the back pain isnt instant, and the aches and pains come on a day or two later. I dont know the speed at which you were hit, but im sure your chest might hurt from the seat belt, and your back and neck from whiplash. Good luck and i hope you dont have any serious injuries.

Since you cannot put a price on trama and cannot foresee the damage in the long run, you can probably sue for millions.

no, the ambulance did nothing. they just ask if anyone was injury and left. thank you.
