Should I Even Bother?

i rear ended someone the other day. i saw the car in front of me started to take off so i yielded and went and the next thing i knew i hitted him cuz he stopped for no reason! after that i didn't move and called the police. i sure regretted it cuz he gave me a ticket for following too closely. he stood there saying he's not suppose to judge who's at fault but then said i was wrong. he also said i should've moved more to the side to let other cars get through cuz since this was a minor accident they could tell who's right and wrong. what a dumbass. the insurance pissed me off too for they automatically said i was at fault and didn't even ask for the other car's damage until i prompted them and they finally said, "oh u can tell me." what the heck was that? aren't you suppose to ask for these things before making a decision? a lot of factors made me mad like the guy i hitted was trying to suck up to the police officer saying that he worked for the people who insured them and giving some names he knew. what a retard.

i'm so mad..why is it the person who hits them from the back always wrong? if they hadn't stopped abruptly then there wouldn't be an accident?! i called the police to help me too but he gave me a ticket instead?! why do i need to call them then? he didn't even see it how can he give me a ticket? everyone is bumper to bumper when they stop. i don't see anyone leaving 3 cars distance. so the only reason why i got the ticket was because i hitted someone not because i followed closely!

anyway the question is, should i even bother going to court and pleading not guilty? do i have any legitimate reason to fight this case? or should i just pay for the ticket cuz i'm going to lose anyway? i don't mind going but i think if you lose u may have to pay more.

Sorry to say, but you're at fault 100%.

Anytime you hit someone from behind it's an open and shut case.

Don't bother wasting your time or money going to court. Pay the ticket and take it as a lesson.

Hope you don't get in any more accidents though smile.gif

Yea even if you try to fight back you won't win. For one they will say that you were tailgating and two tell you that when you drive you should give like a 5-8 feet *or something like that* distance between you and the car ahead of you. There are people out there who actually do that sort of thing on purpose to get money and stuff, but there really is nothing anyone can really do about it because it can never be proven that they did it on purpose.

I speak from experience about rear ending people. Still to this day, I refuse to believe it was my fault. But in your case, it is your fault.

If you lose fighting the ticket, you pay the maximum allowed plus court fees. And no, you don't have a chance from the details you've told.

Because that's the law. Either u were following too closely or you weren't paying attention when he stopped, or both.

You told the officer that you were wrong? That is the worst thing you could've done, because that admission of fault will be on the police record and because of that, the insurance company (your's) has to pay the other person (because by admitting to the police that you made the error and its recorded, the insurance company is now fully liable for your accident).

You didn't take photos of the accident (even with a camera phone is acceptable) as proof of damages, etc.

I don't know what to say but you just have to suck it up and realize that the accident was your fault. We all live and learn. I felt bad about my first accident (which was serious), but life moves on and be glad you didn't get injured.

it's a waste of time going to court. u already pleaded guilty when u told the cop that u we're wrong. one of the rule being on an accident is dont claim that ur at fault. the insurance agents decide who's at fault by investigating damages and story claims.

also rear ending is automatically at ur fault because the driver infront of u has no control during the collision, u do. it sux i know

You rear ended someone.. YOU Lose.

How are you planning to fight a rear end collison from a stop sign? obviously you werent paying attention or didnt do a complete stop. sad.gif
