Man Appeals Fine For Beating Seagull because it tried to eat his wife's ice cream

A Kansas man accused of beating a seagull that tried to eat his wife's ice cream is appealing a $275 fine stemming from the incident in California.

The Orange County Register reported on Friday that Dragan Djuric of Kansas contested the fine levied by the US Fish and Wildlife Service for violating the federal Migratory Bird Treaty Act.

Police say Djuric beat a Heermann's gull with a stick and broke its wing in Laguna Beach on New Year's Eve. The bird was later put down.

Djuric says he was acting in self-defence after the bird swooped down, hit his wife's head and tried to grab her ice cream.

Fish and Wildlife officials say witnesses told authorities the ice cream fell on its own and Djuric struck birds that descended to eat it.

I don't find this funny. Did you guys not read the part where he broke the seagull's wing and it had to be put down? I don't think $275 makes up for an animal's lost life.

An innocent animal was killed cuz this guy didnt want the bird to eat the fallen ice cream? Whats the big deal?!..was the guy going to eat the ice cream that fell on the floor?! selfish..and cruel

well if the bird was swooping down for the ice cream and hit his wife's head it must've been very frightening and he did hit the bird in self defense. what else should he have done? his wife could've been injured, he was just trying to protect her. i feel sorry for the bird though because it probably didn't know exactly what was going on, just that it wanted to eat ice cream but i can see where the man's defense is coming from

i feel bad for the bird but i cant help but find how stupid this man is that its funny. but id be scared too if out of no where a bird came swooping down on my head, if anything id let him have some icecream i could jus buy another one; or not eat it in public after being traumatized.

Although I do agree that nothing justifies him beating the poor bird with a stick (the best solution would have been to run away) if a seagull attacks you you're not necessarily in the superior position. They are strong and dangerous birds when they want something.

i remember when i went to sea world...i saw a seagull swoop over a boy and stole his churro out of his hands...those birds are strong....lol..
