i got mine for $250...
BUT if u buy it off him there is a down side... how long has he been using it for? cause i used mine for a few months and the battery died! i had to mail my ipod to apples to get it replaced. The replacement was free cause i have 1 yr warranty, and ipods is not well known for good batteries.
so if his warranty is over already, and im assuming his ipod would be quite old right? then u might have to spend a lot to replace the battery. so why not buy a brand new one urself.
$40 sounds like a good price but are you only getting the ipod mini and nothing else? it usually comes with a usb cable, belt clip, itunes cd, and earphones at least i think. plus ipod minis are getting rare...
i heard they are not making them anymore ...

i heard they are not making them anymore ...
i already know that. ipod minis have been replaced by ipod nanos and they are not manufactured anymore, which means it's getting almost impossibly hard to find a brand new ipod mini. the few unopened ipod minis still sold in various places on-line have huge prices upwards to $400 even. it's getting rare because it's not being made.

I say get a new one. Who knows how long your friend had it for ? If the battery dies, you have to get a brand new one! Chances are, your friend had it for a long time and there's no telling how much longer the battery will last.
i still think its worth it for 40$
go to www.ipodmods.com
u can get the platinum or watever battery thing
its about 60$
and they send u or u can send in ur ipod
and u get a new battery once a year for as long as u have the ipod
so that will total out to being like 100$ which is still pretty good
