Secondly, tell him straight up to stop bothering you during tests because you don't want to get kicked out of school because someone else is cheating off of you. Don't feel bad for him because he doesn't know the anwer, that's his problem. He should be studying the material.
If he keeps bothering you, tell the professor. Yeah you might feel guilty, but why? You shouldn't be. It's his fault for not studying, and do you really wanna be the poor bystander who gets punished because you couldn't stand up for yourself?
I'm taking a taxi to Kentucky where they don't even know all about me. I just need to feel s a f e.
I've got a thousand sweaters, and shoes, and paintings to hide the skeletons in my way.
But he said, "Slow down, slow down. Think it over, we've all got wretched closets, but silly girl pride kills more than Aids lately."
I said, "Come on, I thought it over. I don't wanna die here. I have no desire to get m♥rried."
Every night I pray for you, don't believe in heaven or that it could be a happy place.

think of it this way. you might think there's little chance the professor will find out the similarity between the answers, but i assure you it could happen. this guy i dated last semester was a graduate student instructor, and he looked out actively for matching answers on the students' reports and such. he reported entire groups of kids to the professor and to honors council. one of those students, i believe, is currently on probation for what he did. it will go on his record. so if you don't take initiative and report that guy to the professor, you might be the one in trouble, and no one's going to believe you when you're on the defensive.

You shouldn't bother talking to the dude, as he wouldn't give a rats ass about what he did to you. Just go up to the professor, or if you want you could send an email to the professor talking about the incident. This way if something did happen, you won't get in trouble and also it won't happen again.

Seriously. This is COLLEGE. You will get kicked out for giving answers to others for a test. Take the right action.
Yeah, I second this. I know people from my college that have been kicked out for cheating and for giving answers as well.

Someone else can put up with the moron sitting next to you. (This will probably happen more than once, don't make a habit of getting pushed around.) Everyone's right. Cheating is an ugly stain on your record. Don't do it.

^ Yea actually I never thought about that. I just assumed that assigned seats were final. I guess as you get older it feels like I question authority less or it's more classless to question and debate against your professor's actions or any one in an authority position.
Thank you everyone for your input. This incident gave me a few extra sleepless nights because of the seemingly added pressure it put on me. I got this test back last week and instead of me and that guy next to me getting failed grades and questionable remarks, 3 other people got red marks on their paper saying they fail for having the same wording. I've asked for separate seating for the final coming up. And it's the fact that I did study hard for it that I felt a greater dilemma and a sense of loss but also that the guy was so rude. He was red in the face when we got our tests back because I said, "Whatever" when he said, "Thanks, It's cause of you I got a B instead of a C". I just didn't understand where he had the audacity to knock his knee against mine and flip the page of my test paper.
Thank you for your support everyone and encouragment to talk to the professor. Sometimes when I'm facing a problem I can't see the solution as quickly or the options for my actions and this was just one of those times. You know when your brain feels numb and you can't think for yourself anymore....well thank you.

what a jerk. I hope he fails the class. Do you mean, "got a B instead of an A" ^^;;;
either way, total sleeze bag.

if it were me, i'd throw his hand away and ask for a different seat and extra time. there's no question about whether it's right or wrong to do so.
1. if he didn't study, he shouldn't be rewarded for doing so.
2. your college has an obligation to provide a safe and fair learning environment for everyone.
3. you need to be focussed and making the most of the time given to you in a test.
4. if your grades are distributed on a curve and he gets a better grade than what he should've got, he will be compressing the curve, which has the potential to actually lower your final grade.
5. "i'll just stand by and let bad things happen to me" is not a very "classy" attitude either
