Totaled My Car My fault?!?!

Ok... I don't know if this belongs here but I really need help from an outsider... Listen to my accident.

At 630 am, it was still dark outside. I was driving, driving. Up ahead, two cars crashed and one parked to the side while one parked right in the middle of the road. They didn't have their emergency lights on, they didn't have a flare or anything. Their car was black. It was a country road so I was driving 55. By the time I saw it which was about the distance my headlights could take me, it was too late already. Is it 100 percent my fault? Because the insurance company said it is.... And has someone also got into an accident when they were 16... How much did the insurance raise you? Should I appeal to the judge if they say I'm completely at fault? How has their parents reacted to this situation? Did they ever get you a new car?

were your headlights on low or high beam? if you rear ended them, technically it would be your fault(in most cases).

if you had your headlights on i dont see how you could have not seen it.

A similar situation happened to my friend. He was driving in the hills. Up ahead was an accident, which really couldn't be seen because it was around a corner. So after he turned the corner and saw the accident, it was too late to really do anything. He wasn't speeding either. In his case nobody was at fault. Technically, anytime you rear end somebody, you're at fault, but because of the circumstances, I would think it can be reduced a bit like what happened with my friend.

Did any of the cars had any of their lights on? If any lights were left on, I believe you should've noticed that you were closing in on a car.

You might've seen it in time to avoid a collision if you had your high beams on, but that's hard to say considering you were travelling at 55mph.

Unless the car was immobilized, I think it should've been taken off the road no more than maybe 5 minutes after their collision. If the car was immobilized, then signal lights or some kind of warning would've helped avoid a collision. There probably is no law stating such things must be done, so you probably don't have anything to back you up here.

hm..... should have reached into your trunk and took out some blunt object.

you can make it so that it isnt your fault.

really though.. sorry to hear about the accident. makes me wanna go get car insurance now

Ha... when i first got my license when i was 16 something similar to this happened to me. It was on halloween back in '00 (great timing) and i was driving my friends home from a party. the weather was really foggy and some dumb *Ahem* double parks on the road without their hazards on. well needless to say i was drivin about 40 on a 35 and since there were so many ppl in my car, it was too late to brake when i saw his car. I clipped the left side of his rear bumper and pretty much jacked up my car more than his. My car being that old raggy '88 corolla and his was an '00 prelude. as for insurance, my rates rose like hell cuz i just got my license and had no real driving experience. i also only had liability so my car was totalled (and had to sit in front of my house for almost a month to remind me of my tough luck) and i was left with nothing but an earful from my parents. some things you just cant do anything about and thats one of the sucky parts of life tongue.gif

unless you have uninsured motorist coverage. If not ur SOL, alternative is to take them to court..

Its technically your fault because you should not drive past your headlights. Basically, you should not drive past the time it takes you to count to 2-3 seconds after your headlights reveals thing.

dang, this is what basically happened to me ohmy.gif and it was yesterday which was halloween but it was in the morning and I had fog+sun+ice :/

i was going to say... damn, you gotta drive at the speed of light to drive past headlight beam.

the situation can be 50/50 if not all at your fault.
no. my first accident was at the age of 18, but that's when i started to drive too.
insurance raised me... hmmm... 5-600 more i think. from 1400-2000 or so, full coverage on a '00 toyota camry 4 cylinder.
if the car is totaled, i am pretty sure your parents (or any other in that matter) will reimburse their children with another car, whether new or used.
