anyway, i just wanted to know whether i should go to court or write an appeal by mail? if i go to court i'll probably won't remember all i have to say. also, do i have much chance pleading not guilty or do people who go over the speed limit (doesn't matter if its a lot or less) automatically get the guilty sentence no argument about that.

If you decide to contest your citation in court, the officer gets paid overtime because he is coming on his day off. Also, the judge usually favors the officer. A written statement is recommended if you decide to contest.

Common sense should have been used. Who in their right mind would decide to drive in a cop's lane? The officer may have been having a bad day and gave you a ticket just for going a couple of miles past the speed limit.

huh? so you're saying we shouldn't drive in their lane? i guess i'll keep that in mind for the future. i mean who would've known i needed to exit and thought it was ok so i kept my cool. i surely underestimated it. but nonetheless, cops do take their power for granted. and personally, i think they pull people over for minor things just because they don't have anything to do which is kinda pathetic. if they're so good then why not go catch crooks instead.
anyway, it looks like there's not much chance. lesson learned.

cuz when i got my ticket the officer said 5 mph above the limit is ok
+5 over the limit is still safe so if u were 5 or less above the limit then u could appeal, but it depends on wat it sayd on ur ticket

i'm so pissed off! i have heard that some people get pull over for going only a few above the speed limit and now i've experienced it too. i was driving along a cop for about a mile and i wanted to move into his lane but couldn't so i decided to move up a bit and signal to get in. u don't slow down when u're changing lanes right. the moment i got into his lane his turn on his freakin sirens and lights like i was deaf or something. c'mon he was only like 5 feet behind me

HP are usually pricks. You can address this in court and the judge will usually hear your side, plus HP's usually don't show up to court.

This has nothing to do with common sense. There is no reason for us civillians to be aware of the police force period. They are here for the reason to protect us from harm(meaning they are suppossed to pose a form of safe atmosphere), yet they are doing a better job at striking fear into civillians. This is a problem and needs to be addressed. I said this to the judge when I got pulled over because the HP had a bad day.
My youth pastor is a police officer and he found out who the officer was, and I guess the HP officer he talked to that gave me a ticket didn't even remember giving me one.
I found it really sad that he didn't even know who he gave citations too, and this is his profession.
Anyway, you will most likely have a court date, or a due date, you can go fight it in court if you want, or have your lawyer take care of the matter.
But since our court system is messed up, your court fees, law fees, might come out to be more then the ticket itself.

I THINK IT'S BETTER IF YOU JUST PAY THE TICKET. most of my friends that had been in the same situation and did the same thing.. they went to court.. they just ended paying more than the fine.
my friend got a ticket ..he got fined 79$ i think .. then went to court.. court cost was like $50 and he lost so he had to pay 166$ i think..

^ uhh why would the police officer remember you? they probably catch hundreds of people weekly. it would be weird if he remembered you.

I tend to remember all of them for atleast several months
And I would think I would remember them even more if I accuse or convict any of them with a law breaking event (stealing, below the table actions, etc..)
And the town I live is small, trust me, he knew who I was.
I am the only asian in the 50 mile radius.

Did you really have to speed up to cut in front, why couldn't you just slow down and get behind him?
Yeah, it's not worth messing with the police. I always drive around 10mph above the speed limit but never had any problem with the cops. I slow down if I see the police car in front of me and I get out of his way if I see police car behind me. Just last week I was driving over 70 on 55 speed limit hw and I saw this police car like 10 feet behind me

Doctor the letters correctly and you'll most likely win. As stated before, the written trial is the best bet. Officers get double overtime for appearing in court. If you send a trial by mail, they get no extra pay, and actually have to write something (oMg occIFerZ cAn WrItE?) semi-intelligent and persuasive to make a case. Worst case scenario is traffic school, which is not bad.
I've gotten 5 speeding tickets in the last few years. 1 I fought in court and won. 2 I fought by mail and won. The other two I worked off with traffic school. Clean record. Don't even mention the other times I've been pulled over and let go.
Regardless of the situation (I'm not going to say if you were right or wrong- I can honestly say that I was illegally and blatantly speeding all 5 times I was ticketed), clear you head and fight your way out of the ticket. It just takes 5 IQ points over the officer's mediocre "I had nothing else to do with my life" brain to outsmart him in court. Do your best.

Never ever pay the ticket, thats basically a a guilty plea... and point on ur record (here in CA) and thus potential of higher insurance rates.

i do
the law allows the speed tracking equipment (such as wheel speed sensor) to be off by 10%, + / -. telling a cop that you were driving 5 mph over is basically admitting that you were speeding.
depending on where you live, local speed limit is around 40, with the law technically you can go 44mph without getting busted. with high ways the speed limit is around 65 and that is technically you cant get busted for a ticket going 71, ever wondered why all the 65mph zone speeding ticket are always written above 72mph? =]

If you get caught going over 100mph, well you're in deep crap. The only way to get urself out is assume it was during the day and it was a empty freeway and you were driving urself only. I could easily say that i was posing no danger to anyone on the freeway, because there were no cars, it was empty, etc. I've seen this trick work under very narrow circumstances...
And lastly, drive a Volvo (like I do), no one ever suspects the Volvo of any wrong doing

WTF what kinda crook you learn that from?, "usually" getting a ticket means you did something wrong... Meaning your guilty of the violation..
does any one know why in general 5 mph over the speed limit is consider legal?
I always assumed it was because everyones, speedometer was off +/- a few mph?
